A bus driver who made a rude gesture at a member of the public and was sacked, has been awarded 5,500 by an employment tribunal.
The tribunal ruled that National Express Dundee was wrong to dismiss driver Scott McDonald, 29, for raising his middle finger at a bus enthusiast photographing his vehicle in Dundee last August.
The incident should have been treated as a ‘one-off’ and, although the driver’s behaviour was stupid, he should have been subject to a disciplinary penalty but not sacked, the tribunal said.
Mr McDonald has since got another job and the tribunal ruled his compensation should be reduced to 5,516.47 because of contributory actions.
National Express Dundee has not commented.
