Abdul Razaq has had his O-Licence suspended for 14 days and cut to three vehicles by TC
Breaches of the drivers’ hours and tachograph rules have resulted in the National O-Licence held by Birmingham-based Abdul Razaq being suspended for 14 days by Traffic Commissioner (TC) Nick Denton.
In addition, the TC cut the authorisation from five to three vehicles on financial grounds saying that Mr Razaq could at any time apply to have that variation cancelled if he could demonstrate that he had regained financial standing for five vehicles.
Mr Razaq had been called before the TC at a Birmingham Public Inquiry (PI).
In his decision the TC said that Mr Razaq had failed to fulfil the undertaking to ensure the observance of the drivers’ hours rules.
A driver had driven for 29 consecutive days and even after Mr Razaq was notified of that by DVSA he still failed to ensure that that driver took the required daily and weekly rests. Even today, Mr Razaq was unable to run or produce driver infringement and missing mileage reports.
It was only because EU rules driving was not the major part of Mr Razaq’s business that the O-Licence survived.
Requiring Mr Razaq’s Transport Manager (TM) William Clayton to attend a two-day CPC refresher course by the end of February, the TC said that he had been extremely slow to take corrective action. His repute was severely tarnished, and it was retained by the slightest margin.
