Senior TC statutory documents gain complementary summaries

Senior TC statutory documents gain complementary summaries

Individual summaries of the statutory documents issued by the Senior Traffic Commissioner have been published in a move that the Office of the Traffic Commissioner says is intended to help O-Licence holders, transport managers, applicants and vocational drivers “to more easily understand the requirements of operator licensing and driver conduct.”

The summaries can be read on the gov.uk website. They do not replace the full statutory document library, which remains available from the same source and explains how Traffic Commissioners should interpret the law.

In a statement, the Office of the Traffic Commissioner outlines a hope that the summaries will collectively provide a readily digestible guide to what the Senior Traffic Commissioner expects of the parties listed above. Reading the summaries alongside the full statutory documents is recommended.

The summaries significantly consolidate the information held in the full documents. As an example, statutory document number 5 on legal entities runs to 32 pages, but the summary of that publication is made up of around 800 words.

Statutory documents were first issued in December 2011 and have regularly been updated since, with document 2 – which covers finance – now on version 21. Legislation requires that Traffic Commissioners act under the general direction of the Senior Traffic Commissioner and that they have regard to any guidance issued by the holder of that post.

According to statutory document 0, the collection describes “the application of legal discretions and [indicates] a proportionate approach to the imposition of regulatory burdens, and in doing so, [provides] guidance and advice to those operators and drivers who are regulated by Traffic Commissioners.”

It adds that the statutory documents “provide greater transparency on the way in which Traffic Commissioners approach their judicial duties and the licensing and other work conducted outside the tribunal room.” Also set within them is a framework for instructions to staff acting in support of the Commissioners.

The most recent major round of updates to the statutory documents was carried out in March 2025, but eight months later, document 6 – on vocational driver conduct – was amended by current Senior Traffic Commissioner Kevin Rooney.
