2 Promotion Terms

By participating in this Promotion, you agree to be bound by these Terms and Conditions, and the Competition Terms and Conditions available at divcom.co.uk/competition-terms.

The Promoter’s decision is final and binding in relation to all matters relating to the Promotion. No correspondence will be entered into. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any participants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion.

3 Promotion Period

1200hrs on 11 October 2023 and will close at 1200hrs on 26 October 2023.

4 Voting Eligibility

No purchase necessary. This Promotion is open to coach, bus and minibus operators, fleet managers, transport managers and any other person professionally connected with the profession. Employees at an entrant’s business are not eligible to vote. DBC employees are not eligible to vote.

Only one vote per participant during the Promotion Period. For the avoidance of doubt only one unique email address will be accepted per participant, and an email address can only be used to vote once. Any participant using multiple email addresses to enter the promotion will be disqualified, their votes will be withdrawn, and any Prize entitlement will be void. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant or has already submitted a vote.

If it becomes apparent in the reasonable opinion of the Promoter that any participant is using any means to circumvent this condition such as, and without limitation, falsifying data; using multiple email addresses; acting fraudulently or dishonestly in the opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase votes or otherwise acting in violation of these terms, these participants will be disqualified, and any Prize entitlement will be void.

Incomplete, misdirected, or votes received outside of the Prize Promotion Period will not be accepted and will not be entered into the Promotion. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.

5 Prize Draw Winner Selection

Voting participants will be automatically entered into the prize draw when a voting form is completed, including contact details, during the Promotion Period.

It is the voting participants’ responsibility to provide their correct, up-to-date details when completing their voting form in order for their Prize claim to be processed. The Promoter cannot be held responsible for a winner failing to supply accurate or complete information which affects Prize acceptance or delivery of their Prize.

The winner will be drawn at random and notified by email on 27 October 2023. The Promoter will attempt to contact the winner by email up to two times. If the winner does not respond to the emails notifying them of their win within 14 days of the second email, they will lose their right to the prize, and the Promoter reserves the right to choose and notify a new winner. The Promoter reserves the right to verify the winner before the Prize can be dispatched and to withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.

6 Voting Prizes

The prize is a £50 Amazon voucher. The prize is non-exchangeable, non-transferable and no cash alternatives will be offered. The Promoter reserves the right to substitute the prize with another of equal or higher value and to cancel the Promotion. This Promotion is in no way sponsored, endorsed, administered, or associated with Amazon.com.

7 Innovation Challenge Winner Selection

The Innovation Challenge entry that receives the most valid votes within the Promotion Period will be awarded the ‘Operators’ Choice’ Award. This entrant will be selected as the Winner after voting closes at 1200hrs on 26 October 2023. The Winner will be notified by email on 3 November 2023.

The Organiser reserves the right to substitute an alternative finalist selection method at its absolute discretion.

This Promotion and ‘Operators’ Choice’ Award selection are not affiliated with the Judges’ Choice Awards’ selection, which will be decided on the sole discretion of the Judges following the finalist pitches on 2 November 2023.

8 Data Protection

Any personal information that entrants share with the Promoter will be kept secure and only used in line with these Terms and Conditions and the Promoter’s Privacy Policy. Participants agree that their information may be used by the Promoter to administer the Promotion in accordance with these Terms and Conditions.

9 Cancellation

The Promoter reserves the right to amend these Terms and Conditions at any time, without prior notice. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties.

10 Jurisdiction

The Promoter reserves the right to amend these Terms and Conditions at any time, without prior notice. The prize draw and these Terms and Conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
