Bus driver Henry Wallace, who had a previous legal claim for disability discrimination struck out, has been awarded £5,949 in a private settlement after seeking compensation for the loss of his job.
He made his disability discrimination claim against West Midlands Travel Ltd at Birmingham Employment Tribunal.
But tribunal Judge Cocks struck out the claim after accusing Mr Wallace of failing to comply with a tribunal order. She said Mr Wallace had failed to make representations in writing.
Mr Wallace then made a legal claim at the same tribunal for constructive unfair dismissal after alleging the firm caused him to resign.
Now tribunal Judge Broughton has announced that after discussion between the two parties Mr Wallace has been awarded compensation by consent.
