Diamond Bus Ltd decision on hold pending appeal

The Traffic Commissioner (TC) for the West Midlands, Nick Denton, has granted a ‘stay’ of his decision on the Diamond Bus Public Inquiry (News, routeone, 15 August) pending an appeal by the company.

This means that his decision will not come into effect while the Upper Tribunal considers the company’s appeal.

Diamond Bus is appealing on the basis that the TC was wrong to reject some of the company’s arguments for a “reasonable excuse” for late or cancelled services.

The Upper Tribunal, which considers appeals against TC decisions, is a separate jurisdiction.
