The TC found that the sole Director had not been entitled to hold a restricted PSV licence
The two-vehicle restricted licence held by Stoke-on-Trent-based Christopher Green has been revoked by Traffic Commissioner (TC) Nick Denton, and a bid for a similar licence by CG Travel Ltd, of which Mr Green is the sole Director, refused.
Mr Green, trading as CG Travel, and the company, both of Kidsgrove, Stoke-on-Trent, appeared before the TC at a Birmingham Public Inquiry.
In his decision, the TC said that Mr Green had operated more vehicles than he was authorised to do. The operation of PSVs had for the last 10 years been the main occupation of Mr Green, meaning therefore that he had not been entitled to hold a restricted PSV licence.
Since January 2016 the operating entity had been the limited company and not Mr Green as a sole trader. CG Travel Ltd did not hold a PSV O-Licence.
Mr Green had failed to fulfill his undertaking to ensure the lawful operation of vehicles. A vehicle was operated while the subject of a prohibition notice on at least 30 June, 3 and 4 July.
He was not satisfied that if the company was granted a licence it would be used otherwise than in the course of a business carrying passengers. At the present time, the company’s only business was the carrying of passengers in PSVs.
He accepted that the company’s intention was to do private hire work in addition, but it had offered no real evidence of future projected income from that source, or of whether or when such income might exceed income from the PSV side of the business.
Finally the TC indicated informally that, if the company were to apply for a standard licence, the chances of success would be increased if Mr Green had meanwhile attended an operator licence management course.
