Tribunal: DCPC required by directors that drive

The Upper Tribunal ruled that directors need a DCPC if they are to drive

The Upper Tribunal has upheld Deputy Traffic Commissioner Miles Dorrington’s findings that the directors of Wigan-based minibus operator Wish Travel are subject to the requirement to hold a Driver CPC (DCPC).

Tony Riley claimed that as a director, his duties went beyond a driver’s and that DCPC did not apply to him.

He added that he was carrying his phone, which is equipment that he uses as a director, and that DCPC only applies to employed drivers.

Leandra Mallinson also made a similar claim. Both were convicted of driving without a valid DCPC.

The Upper Tribunal dismissed the argument that DCPC did not apply as “manifestly absurd.”
