The Health & Safety Executive is to prosecute Bridgend Council over the death of Ashley Talbot, 15, who was killed at Maesteg Comprehensive School in December 2014.
He was hit by a minibus, causing multiple injuries, and he died at the scene. The teacher who was driving has not been prosecuted.
The council is being charged under Section 3 (1) of the Health and Safety at Work Act, which requires employers “so far as is reasonably practicable” to ensure that non-employees are not exposed to risks to their health or safety.
A date for the court hearing has yet to be announced.
