It would appear that an amendment to driving licence regulations in 2014 has not filtered through to all those affected.
Before 2014, maintenance staff who had held Category C entitlement for at least two years were permitted to drive a Category D vehicle damaged or defective and being driven to a place for repairs or being road tested after being repaired, provided that no person was carried who was not connected with the vehicles repair or road testing. This was covered in the Motor Vehicles (Driving Licences) Regulations 1999 – Regulation 7.
Regulation 4 of the Motor Vehicles (Driving Licences) (Amendment) Regulation 2014 has removed this exemption. Therefore the driver of a Category D vehicle must hold a category licence under all circumstances i.e. even when the vehicle is not being driven for hire or reward.
