BCA sets ball rolling for Judicial Review over S19 abuses
Lawyers acting for the Bus and Coach Association have issued a pre-action protocol letter for Judicial Review (JR) over the failure of the DVSA to take any regulatory action over the abuse of Section 19 contracts
The letter says that the grounds for the JR are: “The ongoing failure by the DVSA to commence any prosecutions, or take other regulatory action, against any community transport company in the UK for breach of section 12(5) of the Public Passenger Vehicles Act 1981, and the failure to enforce EC Regulation 1071/2009 and the ongoing failure by the Traffic Commissioner to open a public inquiry, or otherwise take any regulatory action.”
The letter has been sent to all three parties concerned, says 
Martin Allen of the Bus and Coach Association.
