A bus driver who was on a final warning for being involved in a previous incident, was sacked after allegedly failing to stop for passengers, Watford Employment Tribunal heard.
Al Joomun had been employed by Abellio London, which covers South and West London and North Surrey.
Mr Joomun made a legal claim for unfair dismissal after being sacked for misconduct from Hayes Depot.
The tribunal was told that Mr Joomun failed to stop on two occasions on route 350 at a bus stop at Heathrow terminal.
As a result passengers complained and an inquiry was carried out.
On one occasion three passengers were said to have been sitting on a bench at the bus stop waiting to get on the bus and one of them stood up and tried to attract the driver’s attention.
Abellio told the tribunal that there are ‘white’ bus stops and ‘red’ ones and that a driver was compelled to stop at a ‘white’ stop, whether or not there were passengers.
Mr Joomun told the tribunal there had been a bus in front of him and he believed there were no passengers to pick up. He said he should not have been dismissed.
Abellio said Mr Joomun had been on a final warning resulting from an incident in June 2016.
On that occasion he was accused of using a mobile phone in his cab with the engine turned on.
A witness told the tribunal that Mr Joomun was lucky to have escaped dismissal following the first incident.
He said he was using his mobile phone to report an accident but he was accused of not reporting the accident immediately – allegedly waiting three stops before making the call.
Tribunal Judge Small found in favour of Abellio and rejected Mr Joomun’s claim.
