A minibus driver who shuttled holidaymakers to and from Leeds Bradford airport has been awarded nearly £5,000 after losing his job following a takeover.
David Lister was one of six drivers employed by Leeds Car Parks to take people from their cars on a Leeds parking site to the airport.
But he was dismissed by Apcoa Parking (UK) Ltd over a driving licence dispute. Leeds Employment Tribunal Judge Rogerson ruled that Apcoa had taken over the other firm.
Mr Lister had made his claim for unfair dismissal against Apcoa, but it denied the takeover.
Judge Rogerson ruled that Mr Lister was unfairly and wrongfully dismissed.
Mr Lister had worked for Leeds Car Parks from 2014. After the takeopver he continued to be paid. Mr Lister was eventually sent a letter by Apcoa telling him he faced a disciplinary charge.
The letter accused Mr Lister of failing to meet the requirements of his PSV licence “and updating his driving licence as required by the DVLA” which c”onstituted a breach of his employment with Apcoa as a bus driver.”
Mr Lister was accused of gross misconduct and was eventually dismissed.
Mr Lister admitted he had made a mistake but accused the respondents of “inconsistent treatment.”
He alleged that other drivers had been driving in contravention of restrictions on their licences and that no disciplinary action had been taken against them.
