Wish Travel is poised to launch a claim in Wigan County Court for loss of earnings, against the Traffic Commissioners Office (NW Region) and Wigan Council.
The firm, headed by Tony Riley, is the first to make such a claim. It is valued at least at £140,000, but is subject to change on disclosure of records.
It comes following the award of commercial home-to-school contracts to holders of Section 19 permits.
The claim argues that the TC and council “breached their duty of care” by failing to apply EC Regulation 1071/2009.
The firm says it “applied for numerous contracts” that were awarded to holders of Section 19 permits, in breach of the Regulation.
Says Mr Riley: “I have set up a YouTube account specifically to unite operators and explain the s19 permit case I am about to lodge.
“I want people to comment on the video and unite everyone online so that we are not divided.”
