One driver withdraws claims, the other’s is accepted

A driver who alleged he was unfairly dismissed by a group providing ring and ride buses across a wide area of the Midlands has withdrawn three legal claims.

Tom Harris made legal claims against Accessible Transport Group of Park Road, Birmingham.

The claims involved unfair dismissal, the unlawful deduction of wages and an allegation under the working time regulations.

The group says it is a non-profit making organisation running a total of 120 ring and ride buses for old and vulnerable people in the Midlands.

Tribunal Judge David Dimbylow said the legal claims made by Mr Harris had been withdrawn and the case had now been dismissed.

A group spokesman declined to comment.

In another case at the same Tribunal, a coach driver has been told he can go ahead with legal claims against a coach and minibus firm after complaining he was unfairly dismissed.

Stan Phillips originally made his claims at Birmingham Employment Tribunal for breach of contract, unlawful deduction of wages, unfair dismissal and a claim under the working time regulations against Evergreen Coaches, which has bases at Smethwick and Halesowen.

Only the claims for unfair dismissal and breach of contract are to be dealt with following a preliminary hearing under Tribunal Judge Jill Kelly.

She told Mr Phillips that his remaining claims will be heard at a full Tribunal at a later date.

The firm is to oppose the claims.
